Welcome to NutriFlex®. By accessing our website, purchasing products, or using our services, you agree to the following Terms & Conditions. Please read them carefully.

1. Electronic Communications

By using this Website or communicating with the Provider electronically, the user consents and acknowledges that any and all agreements, notices, disclosures, or other communications satisfy any legal requirement, including but not limited to the requirement that such communications should be in writing.

2. eCommerce & Privacy

The Website www.nutriflex.co.za sells holistic pet nutrition products online.

  • Using any product or service bought from this Website is at the purchaser’s own risk.

  • The purchaser indemnifies and holds the Provider harmless against any loss, injury, or damages sustained as a result of using the products sold on the Website.

  • NutriFlex® does not provide veterinary or medical advice. All content and communication is for general educational purposes only. Our products are not intended to diagnose, treat, cure, or prevent any disease.

  • Customers remain fully responsible for consulting a qualified veterinarian regarding their pet’s health.

The private information required to execute orders (personal details, delivery address, contact number, etc.) will be kept in the strictest confidence and not sold or made known to third parties, except where necessary for delivery. Credit card details are not stored by the Provider under any circumstances.

The Provider cannot be held responsible for security breaches occurring on the User’s device (PC, tablet, mobile, etc.) due to inadequate protection.

The Provider will supply all goods to the delivery company in good order and will not be liable for the condition of goods upon arrival at the User’s address.

3. Online Payment – PayGate Payment Gateway

  • Card transactions will be acquired for SmartPack PTY Ltd via PayGate (Pty) Ltd, the approved payment gateway for all South African acquiring banks.

  • PayGate uses the strictest encryption (SSL3). No card details are stored on the Website.

  • Customer details are stored separately by SmartPack PTY Ltd and not by PayGate.

4. Responsibility

SmartPack PTY Ltd takes responsibility for all aspects of the transaction, including the sale of goods, customer service, support, dispute resolution, and delivery of goods.

5. Accepted Methods of Payment

All transactions are in South African Rand (ZAR). Payment methods include EFT, debit card, and credit card.

6. Refund and Return Policy

  • Goods and services are subject to availability. If unavailable, the Provider will refund the client in full within 30 days.

  • Client order cancellations attract a 10% administration fee.

  • The Provider reserves the right to cancel an order (e.g. insufficient stock or quality concerns). A full refund will then be issued.

  • Returns are accepted within 7 days of delivery if unopened and in original packaging. Opened or used products cannot be returned for hygiene reasons.

  • Shipping fees are non-refundable.

7. Updating of Terms and Conditions

The Provider reserves the right to change, modify, add, or remove from portions or the whole of these Terms and Conditions at any time. Changes become effective once posted. Continued use of the Website constitutes acceptance.

8. Copyright and Intellectual Property Rights

All content on the Website (including text, images, branding and product names) is protected under South African and international copyright law. No content may be reproduced without prior written consent.

9. Limitation of Liability

  • The Website and its Content are provided “as is” and may include inaccuracies.

  • NutriFlex®, SmartPack PTY Ltd, affiliates, or subsidiaries shall not be held responsible for any direct, indirect, or consequential damages related to use of products, information, or the Website.

  • Our liability is strictly limited to the purchase price of the product(s) in question.

  • By completing checkout, the User indemnifies NutriFlex® against any claims, losses, or expenses arising from reliance on our products or general guidance.

10. Privacy – Casual Surfing

Visitors may browse without submitting personal information. Standard web analytics (IP addresses, time spent, pages viewed) may be collected and used for improvement.

11. Choice of Law

These Terms are governed by the laws of South Africa. The User consents to the jurisdiction of the Witwatersrand High Court in the event of any dispute.

12. Merchant Outlet Country and Transaction Currency

The merchant outlet country is South Africa. Transaction currency is South African Rand (ZAR).

13. Disclaimer

While NutriFlex® takes every reasonable measure to ensure product quality and safety:

  • Information provided is not medical or veterinary advice.

  • Recommendations are general only.

  • Customers must consult a veterinarian before using products if uncertain.

  • NutriFlex® accepts no responsibility for adverse reactions or misuse.

14. Country of Domicile

This Website is governed by the laws of South Africa. Domicilium citandi et executandi:
